Terms and Conditions

These terms and conditions (the "Terms") govern the mutual rights and obligations of the parties arising in connection with a purchase contract concluded through the Blastero e-shop, available at blastero.eu.

1. Parties

Seller: Blastero s.r.o., Company ID: pending, registered in the Czech Republic, contact email: info@blastero.eu (the "Seller").

Buyer: a natural or legal person entering into a purchase contract with the Seller via the e-shop. Where the buyer is a consumer, the relationship is governed by Czech Act No. 89/2012 Coll. (Civil Code), Czech Act No. 634/1992 Coll. on consumer protection, and European Union consumer protection law.

2. Scope and acceptance

By placing an order, the buyer confirms that they have read and accept these Terms in the version in force at the time of the order. These Terms form an integral part of every purchase contract concluded via the e-shop.

3. Goods and description

The subject of sale is gel blasters and related accessories. Descriptions, images, and parameters shown in the e-shop are informational. The data confirmed in the order are binding. Minor differences in color between photographs and reality, due to the display device, do not constitute a defect in the goods.

4. Prices and taxes

All prices are quoted in EUR (€) including VAT at the rate applicable in the EU country of delivery. The price of the goods does not include shipping, which is shown to the buyer in the cart before placing the order. The final amount payable is shown bindingly before the order is confirmed.

The Seller reserves the right to adjust prices at any time. The price applicable at the moment the buyer places the order is binding for that order even if the price subsequently changes.

5. Conclusion of the purchase contract

  • An order placed by the buyer is a proposal to conclude a purchase contract.
  • The purchase contract is concluded the moment the confirmation email from the Seller is delivered.
  • An automatically sent acknowledgment of receipt of the order is not an acceptance of the proposal to conclude the contract.

6. Order rules and limits

The Seller reserves the right to refuse, restrict, or cancel an order, particularly in the following cases:

  • stock depletion or unavailability of the goods;
  • reasonable suspicion of unauthorized purchase, fraudulent activity, or abuse of discounts and marketing promotions;
  • a clearly non-standard order volume intended for unauthorized resale;
  • the buyer has repeatedly failed to take delivery or to pay for past orders;
  • the buyer has failed to provide truthful and complete contact and delivery details.

The Seller may set quantity limits per customer, household, or delivery address. The buyer will be informed without undue delay if the order is not accepted; any amount already paid will be refunded in full using the same payment method.

7. Obvious errors in price and description

In the event of an obvious error in the price, description, or availability of goods on the e-shop (e.g. an error caused by a technical fault, a price clearly disproportionately low compared with the standard price for comparable goods on the market, a missing parameter) the purchase contract is not formed, or may be cancelled unilaterally. The Seller will contact the buyer without undue delay with a corrected price; the buyer is entitled in that case to withdraw from the contract free of charge and receive a full refund of any amount already paid.

8. Payment methods

Payment can be made by:

  • payment card (Visa, Mastercard);
  • Apple Pay, Google Pay;
  • PayPal;
  • SEPA bank transfer.

Goods are dispatched once the payment is credited to the Seller's account, unless otherwise agreed. All payment data are processed via encrypted connections by certified payment partners; the Seller does not store payment card details.

9. Delivery of goods

Shipping terms, dispatch, delivery times, and fees are set out in detail in the Shipping and delivery document, which forms an integral part of these Terms. Risk of damage to the goods passes to the buyer upon taking delivery from the carrier.

10. Right of withdrawal

The consumer-buyer has the right, under § 1829 of the Civil Code, to withdraw from the contract within 14 days of taking delivery, without giving a reason. Details, the procedure, excluded cases, and the conditions for refund of the purchase price are set out in the Returns and complaints policy.

11. Statutory liability for defects (statutory warranty)

The Seller is liable to the consumer-buyer for defects that exist at the time of taking delivery, and for defects that appear within the statutory 24-month period from delivery, to the extent set out in the Civil Code and EU Directive 2019/771. This statutory liability cannot validly be waived; any provision shortening the consumer's statutory rights is ineffective.

12. Contractual quality guarantee

In addition to the statutory liability for defects, the Seller provides the buyer with a contractual quality guarantee on the following terms:

  • Gel blasters: 6 months from delivery on manufacturing defects of the mechanism.
  • Accessories: 3 months from delivery.

The contractual guarantee does not replace the statutory liability under article 11 but extends the Seller's services (in particular faster handling, like-for-like replacement, etc.). The contractual guarantee does not cover defects caused by normal wear and tear, improper handling, modification of the product, or use contrary to instructions.

13. Product safety and age restriction

All goods offered carry the CE marking and meet the requirements of EU Directive 2009/48/EC on toy safety. The gel balls used are water-based and biodegradable.

Gel blasters are intended for people aged 14 and over. By placing an order, the buyer confirms they meet this age requirement. The Seller reserves the right to refuse a sale where there is reasonable suspicion the buyer does not meet this requirement. When buying as a gift, the buyer is responsible for ensuring the end user meets the age requirement.

14. Buyer's account and accuracy of details

The buyer is obliged to provide truthful, accurate, and complete contact and delivery details when ordering, and to keep them up to date throughout the order process. The Seller is not liable for damage caused by inaccurate or incomplete details provided by the buyer (non-delivery, return by the carrier, delayed delivery).

Where re-delivery becomes necessary due to such inaccurate details, the buyer bears the cost of re-delivery.

15. Prohibited uses

The buyer agrees to refrain, when using the Blastero e-shop, from any conduct that would:

  • breach applicable Czech or European Union law;
  • infringe the intellectual property rights of the Seller or any third party;
  • harass, threaten, or intimidate other users or the Seller's staff;
  • spread false or misleading information;
  • involve automated data collection (scraping), overloading the e-shop's infrastructure, or disrupting its security or operation;
  • involve inserting malicious code (viruses, malware) or circumventing security mechanisms;
  • aim at obtaining other people's personal data or login credentials.

Breach of any obligation under this article entitles the Seller to unilaterally terminate the buyer's access to the e-shop and to claim damages.

16. Intellectual property

All content on the Blastero e-shop — in particular text, photographs, graphics, illustrations, logos, trademarks, the trade name "Blastero", videos, and software components — is protected by copyright and other intellectual property laws. The Seller is the exclusive holder of the relevant rights or uses them under license.

The buyer is granted only a limited, non-exclusive, non-transferable right to view the content of the e-shop for personal, non-commercial purposes. Copying, distributing, modifying, publicly communicating, or otherwise commercially exploiting the content without prior written consent from the Seller is prohibited.

17. Third-party links and tools

The e-shop may contain links to third-party websites and services (e.g. payment gateways, carriers, social networks, review platforms). These sites and services are not under the Seller's control; the Seller is not liable for their content, availability, or accuracy. Use of third-party services is governed by their own terms.

Optional tools (e.g. recommendation widgets, reviews, beta features) are provided "as is", without any warranty of functionality.

18. Limitation of liability

The Seller is liable for damage caused to the buyer to the extent established by Czech and European consumer protection law. These rights cannot be validly excluded or limited; any provision of these Terms purporting to do so is ineffective to the extent of the conflict with the law.

To the extent permitted by law, the Seller is not liable for:

  • damage caused by improper use of the product contrary to the user manual;
  • damage caused by intentional modification or damage to the product by the buyer;
  • damage caused by use of the product in breach of the age restriction or without recommended protective equipment;
  • indirect, consequential, or lost profits, unless such liability is expressly imposed by law.

19. Indemnification by the buyer

The buyer is obliged to indemnify the Seller for any damage suffered as a result of intentional or grossly negligent breach of these Terms by the buyer, in particular as a result of:

  • breach of article 15 (Prohibited uses);
  • infringement of the Seller's or any third party's intellectual property rights;
  • fraudulent conduct in connection with the order or payment.

This provision does not affect the consumer's statutory rights.

20. Force majeure

The Seller is not liable for failure to perform or delay in performing its obligations caused by force majeure circumstances that could not reasonably have been foreseen or prevented at the time of contracting — in particular natural disasters, armed conflicts, pandemics, carrier strikes, power or communications outages, payment system outages, embargoes, or decisions of public authorities.

If the force majeure circumstances last longer than 30 days, either party is entitled to withdraw from the contract; any purchase price already paid will be refunded to the buyer in full.

21. Termination of access to the e-shop

The Seller reserves the right to unilaterally terminate or restrict the buyer's access to the e-shop, in particular in the following cases:

  • repeated breach of these Terms;
  • repeated unpaid or unjustified chargebacks;
  • fraudulent conduct or reasonable suspicion thereof;
  • abuse of the discount system, marketing promotions, or returns programme.

Termination of access does not extinguish obligations that arose before termination (in particular the obligation to pay the purchase price for goods already delivered).

22. Personal data protection

Processing of the buyer's personal data is carried out in accordance with EU Regulation 2016/679 (GDPR) and Czech Act No. 110/2019 Coll. Details on the scope, purpose, legal basis, and retention periods are set out in the separate Privacy Policy document.

23. Governing law and dispute resolution

The contractual relationship between the Seller and the buyer is governed by Czech law and European Union consumer protection law. This choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law of the EU member state of their habitual residence.

The body competent for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority, ADR unit, Štěpánská 567/15, 120 00 Prague 2. Consumers from other EU member states may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

24. Changes to the Terms

The Seller reserves the right to change these Terms at any time. The current version is always published on the Blastero e-shop with the effective date marked. For purchase contracts already concluded, the version of the Terms in force at the moment the buyer placed the order applies.

If the change to the Terms is material (e.g. modification of the right of withdrawal or the way complaints are handled), the buyer will be informed in a suitable way (email or visible notice on the e-shop) at least 14 days before the change takes effect.

25. Severability

If any provision of these Terms is found invalid, ineffective, or unenforceable, it does not affect the validity and enforceability of the remaining provisions. The invalid provision will be replaced by one whose meaning and economic purpose most closely approximate the invalid provision and which is consistent with the law.

26. Entire agreement

These Terms, together with the Shipping and delivery, Returns and complaints policy, Privacy Policy, and order confirmation, constitute the entire agreement of the parties regarding the subject of the purchase contract and supersede all prior oral or written agreements between the parties. The fact that the Seller does not enforce a particular right under these Terms does not constitute a waiver of that right in the future.

28. Effectiveness

This version of the Terms is effective from 26 May 2026.
